$10,000 not counting attorney fees and costs. Libel and slander are excluded. Collection agencies and assignees can't file, with a narrow health care exception. If the claim is $7,500 or more, the defendant can have it moved to the regular docket; under $7,500 the judge decides.

Lawyers: Not required. A company can appear through an officer, member, manager, partner, trustee or regular full-time employee.

How it works in Oklahoma

  1. File your claim with the court clerk in the right county. Most clerks have the forms.
  2. Give the defendant's mailing address. The clerk usually serves by certified mail, or use the sheriff or a private process server.
  3. The clerk sets a trial date, which must be within 60 days of filing.
  4. Gather your documents and witnesses. Written statements generally don't count unless the writer testifies.
  5. If you want a jury (claims over $1,500) or a reporter, tell the clerk in writing at least two working days before the defendant's appearance date.
  6. If you win, collect through garnishment, execution on property or an asset hearing.

What it costs

Base fee is $45 for claims of $5,000 or less and $150 for claims over $5,000 up to $10,000. Other assessments and mailing costs can raise the total, so ask the county clerk.

12 O.S. § 95. These are general limits. The clock can start late, pause or be much shorter, as it is for claims against a government agency.

If you lose

Either side can appeal to the Oklahoma Supreme Court under ordinary civil appeal rules, within 30 days after the judgment is filed.

H.B. 1611 (Laws 2024, c. 108), effective 1 November 2024, amended § 1751 to let companies appear through non-lawyer representatives. The $10,000 limit did not change. Uniform fee schedule reissued effective 1 November 2025. S.B. 876 (2025) proposed amending § 95. The copy of Title 12 I read still shows 5, 3 and 2 years. I could not confirm the bill's final status.
