Good to know

Not counting interest and costs. You can ask for more but can collect only $7,500, and you can't split a claim. Each plaintiff is limited to 2 claims a month and 18 a year per county. Someone who was assigned a claim generally can't file.

Lawyers: People normally represent themselves, but a defendant can hire an attorney by filing form JDF 256 at least 7 days before trial, and the plaintiff may then have one too.

How it works in Colorado

  1. Fill out the Notice, Claim and Summons (form JDF 250). Don't attach exhibits.
  2. File it with the clerk in the county where the defendant lives, works or has a business office, and pay the fee. The clerk sets the trial date and may require mediation.
  3. Have each defendant served at least 15 days before trial by the sheriff or a process server, or by the clerk's certified mail. You can't serve the papers yourself.
  4. Try mediation if ordered or if you choose to, and file a stipulation (form JDF 75) if you settle.
  5. Bring numbered exhibits, copies and witnesses to trial. There is no jury, and you must collect any judgment yourself.

What it costs

$31 for claims up to $500, and $55 for claims over $500 up to $7,500. A fee waiver is available on form JDF 205.

C.R.S. §§ 13-80-101(1)(a) (contracts), 13-80-102(1)(a) (torts), 13-80-101(1)(n) (three years for vehicle injury or damage), 13-80-103.5 (six years for a set debt or sum due). These are general limits. The clock can start late, pause or be much shorter, as it is for claims against a government agency.

If you lose

Either side can appeal to district court by filing a notice of appeal and bond within 14 days of the judgment; the review is based on the trial record, not a new trial, though the court may order one.

No limit change taking effect in 2024, 2025 or 2026 was found, and the 2026 Colorado Revised Statutes still show $7,500. The fee list says the legislature raised many filing fees on 1 January 2025 (HB 24-1286), but the small claims plaintiff fees it lists match the December 2023 court guide.
